VoIP Not Subject To State Rules, Says FCC

The FCC yesterday backed a petition from VoIP provider Vonage ruling that its business was ‘interstate’ in nature and therefore free from individual state regulation. The decision is also likely to benefit AT&T and its CallVantage service, Verizon’s VoiceWing operations, and other telephone and cable television companies who now won’t have to answer to 50 different state utility regulators.

FCC Exempts VoIP Phone Service From State Regulation

The Federal Communications Commission ruled Tuesday that providers of Internet-based phone call services fall under jurisdiction of the federal government and cannot be regulated by states, a step that could help boost the emerging services.
Commissioners voted 5-0 in favor of Vonage Holdings of Edison, N.J., which had asked the agency to declare the company's product an interstate service, giving the FCC regulatory control.
Vonage has been battling public utilities officials in Minnesota who want the company to register in the state as a telecommunications service, subjecting it to rate regulation and other state rules.
The ruling applies to cable, phone and other companies offering an Internet phone service similar to the one Vonage provides. The decision does not, however, preclude states from imposing some taxes and fees. It also does not address access charges, which are fees paid to local phone companies for completing calls sent via the Internet to conventional phones.

WASHINGTON -- The Federal Communications Commission Tuesday granted a petition by Vonage Holdings Corp. asking that its voice over Internet protocol, or VOIP, service be treated as interstate, putting it under federal jurisdiction.
The ruling shields Internet telephony services like Vonage's from state regulatory oversight, including similar Internet-enabled services provided by cable companies.
"This landmark order recognizes that a revolution has occurred," said FCC Chairman Michael Powell. "What today's decision does is put the Commission in a firm position of responsibility."
Vonage petitioned the FCC in September 2003 for federal preemption from state regulations that had been imposed by the Minnesota Public Utilities Commission.
In a statement, Vonage Chief Executive Jeffrey Citron said "because the FCC has acknowledged the reality of the Internet - which knows no state boundaries and no borders - more people will enjoy the benefits of Internet phone service."

The Federal Communication Commission (FCC) made it official today that voice over IP services are under federal jurisdiction only so-called federal preemption--and that states may not require VoIP services to meet their existing regulations for traditional telephone services.
Specifically, the commission ruled that Vonage Inc.'s Digital Voice service "is not subject to traditional state public utility regulation." The FCC ruling further stated "other types of IP-enabled services, such as those offered by cable companies, that have basic characteristics similar to DigitalVoice, would also not be subject to traditional state public utility regulation."
The commission based its decision on its power to preempt state regulations that "thwart or impede federal authority over interstate communications." States cannot require, as the State of Minnesota's Public Utilities Commission attempted to do, for example, that Vonage or other similar services obtain a certificate to offer service in the state.
One requirement of the Minnesota certificate was that Vonage offer emergency 911 service in the same way that TDM telephone companies do, which would have been impossible.

In a decision with wide implications, the Federal Communications Commission ruled today that the VoIP (voice over Internet protocol) service from Vonage, dubbed DigitalVoice, will not be required to follow state public-utility regulations.
The ruling puts VoIP service into the same category as other IP-based services offered by cable and DSL providers, such as email and Web access. As such, Vonage will not have to adhere to the state regulations that compel landline providers to pay for 911 services, apply for certification, and face rate oversight.
Vonage presented its case to the FCC because it had been at odds with the Minnesota Public Utilities Commission, which wanted the VoIP provider to register as a standard telephone provider.

SAN FRANCISCO (CBS.MW) -- In what is considered a victory for Internet phone-service companies, the Federal Communications Commission ruled Tuesday that such services fall under the jurisdiction of the federal government and not individual states.
However, industry analysts say that the decision remains a very top-level one, and leaves at least some long-term issues unanswered.
The unanimous FCC decision ruled that Internet phone service offered by Vonage Holdings would be labeled as interstate service, and thus subjected to federal oversight. Vonage had been disputing a Minnesota state attempt to have so-called voice over Internet protocol, or VOIP, service treated as intrastate service that would fall under the regulations of each state's telecom guidelines.
The FCC ruling could have implications beyond Vonage's business: Consider cable television and phone companies, which are branching out to offer VOIP service.

In a major win for the burgeoning Internet phone industry, a federal agency ruled Tuesday that some state telecommunications regulations do not apply to Vonage Holdings and similar providers.
The Federal Communications Commission ruled 3-2 that states are now barred from imposing telecommunications regulations on Internet phone providers, which treat calls no differently than any other application on the Internet. That class of operators includes Vonage Holdings, which asked the FCC for just such a designation in May, plus Verizon Communications, AT&T and dozens of other commercial Internet providers, according to those familiar with the FCC's thinking.
If anything emerged Tuesday from that decision, it was, as FCC Chairman Michael Powell put it, that "distance is dead." Existing federal, state and city phone regulations have one thing in common: each relies on where a call begins and ends, which reflects the dominant phone technology at the time these rules were written. But Vonage, AT&T, and other phone service providers use the unregulated Internet, and history is replete with failed attempts to apply geographic-based rules. On Tuesday, when a divided commission was voting 3-2 on an Internet phone issue, the five members did agree on one thing: that geography should play a limited role in future decisions involving VoIP--voice over Internet Protocol technology.

Today, VoIP pioneer Vonage won the battle, but time will tell if it wins the war. During its monthly open meeting this morning, the Federal Communications Commission ruled Vonage's DigitalVoice service "is not subject to traditional state public utility regulation." In addition, the agency said that other types of IP-enabled services that look and feel like DigitalVoice will be exempt as well.
Vonage CEO Jeffrey Citron is breathing a measured sigh of relief, and he responded to the vote in a statement that read, in part, "This forward-thinking decision from the FCC assures that competition from VoIP is here to stay. Now we can focus our resources exclusively on building an even better service, rolling out E-911 for all our subscribers, innovating new features and new devices for VoIP, and expanding aggressively around the globe." He added that the "clarity" the VoIP industry now has will help VoIP carriers not only to add to the country's bottom line but also to push the country's broadband agenda.

WASHINGTON -- A narrowly drawn decision today from the FCC that puts federal jurisdiction over emerging VoIP services above state jurisdiction could affect how wireless services are regulated.
The FCC claimed jurisdiction over rules governing Vonage Corp.'s DigitalVoice IP-based services weren't subject to the state of Minnesota's regulatory policies concerning carrier entry and provision of E911 services. In what was viewed by FCC Chairman Michael Powell as a "landmark day" for telephone service, the FCC said because VoIP service is inherently inter-state, not intra-state, it couldn't be regulated effectively by state commissions without creating an impenetrable thicket of regulations.
Although the order issued by the commission is very narrow and concerns only Minnesota's jurisdiction, it is interpreted to have a much wider application to all states. It sets the stage for a host of other decisions on how the federal government will handle VoIP services and technology.
