Pickering Leads Congressional Push For FCC Pre-Emption Of States On VoIP

A group of 62 Congressmen signed a letter to FCC Chairman Michael Powell that urges the commission to declare that voice-over-IP calls are "inherently interstate" in nature and, therefore, not subject to state economic regulation.
The much-anticipated letter reflects the views of most FCC commissioners that the agency should have sole economic jurisdiction over VoIP calls--a position also taken in legislation sponsored by Rep. Chip Pickering (R-Miss.), who spearheaded the letter campaign.

"Each of the pending legislative proposals incorporates a fundamental provision that declares VoIP services to be inherently interstate in nature. We believe that such an important, but narrow, finding cannot wait for a more comprehensive VoIP bill to work its way through the legislative process," the letter states.

Sixty-two members of Congress on Tuesday asked the FCC to rule that Internet phone service is an interstate service subject only to federal jurisdiction.

Rep. Chip Pickering (R-Miss.) said in a press release VoIP service “must develop and prosper without the threat of a patchwork of state regulations stifling the innovation.” In the letter addressed to FCC Chairman Michael Powell, the members of Congress asked the commission to “immediately declare that it has exclusive jurisdiction over VoIP services.”

Vonage To Hear From 3 Contenders

Boston - Internet phone company Vonage said it will hear presentations this week from three finalists vying for its estimated $50-75 million ad account.

Still in contention are Havas-owned Arnold in Boston; Aegis Group's Carat in New York; and Interpublic Group's Lowe in New York, which is pitching with aQuantive's Avenue A/Razorfish in Seattle, a Vonage representative said. A decision is expected within the next two weeks.

Five years ago, running a telephone company was an immensely profitable proposition. Since then, those profits have inexorably declined, and now that decline has taken another gut-wrenching dip.

On Oct. 1, both AT&T (nyse: T - news - people ) and Vonage, two pioneers in selling phone service over the Internet, announced price cuts in their new service, proving that the nascent service isn't too young for a price war to break out.

AT&T cut the price of its voice-over-Internet Protocol service 14%, to $30 a month from $35. Vonage, a small, New Jersey-based company that has led the way in using VoIP as a replacement for residential phone lines, immediately responded in kind. It cut the price of its main service plan by $5, to $25 a month.

Calling online costs a bit less -- last week, two Internet broadband phone providers cut their prices for unlimited nationwide calling by $5 a month.

AT&T Corp. lowered fees for its CallVantage Internet phone service from $35 a month to $30 on Friday, the same day rival Vonage Inc. dropped rates for a comparable plan from $30 to $25. Both plans include unlimited calling throughout the United States and Canada to customers with the high-speed Internet access needed to transmit voice data without interruption.

VoIP Price War Has Started, Some Say

Drops in pricing for two major Internet phone services signal the start of a price war as providers struggle to attract consumer attention, some analysts said Friday.

The rate cuts raise the question of whether anyone will ever make any money selling Internet phone service, which is also known as voice over Internet protocol.

But AT&T and Vonage, the two providers that slashed monthly fees by $5, have differing takes on whether further cuts will be necessary.

"We think it's probably pretty much bottomed out," said AT&T spokesman Kerry Hibbs. "We can't go down $5 every month."

A technology that was once the domain of computer-savvy college students looking to save a buck or two on long distance is on the verge of going mainstream. It can enhance portability, lower the cost of calls and allow just about anyone to have a more prestigious area code than, say, 602.

By the end of 2006, 1.8 million households will be making calls from phones plugged into the Net, up from 135,000 users in 2003, according to In-Stat/MDR, a Scottsdale research firm that tracks the telecommunications industry.

"If last year was the year of spectrum, this is the year of VoIP," said Robert Pepper, Chief of Policy Development at the FCC. In the first three months of this year, the FCC has issued an historic declaratory ruling on VoIP (the Pulver.com petition), initiated a Communications Assistance for Law Enforcement (CALEA) rulemaking proceeding on VoIP, and launched a far-ranging Notice of Proposed Rule Making (NPRM) concerning "Everything over IP" (EoIP). In addition to the Pulver.com petition (now resolved), there are also at least five other declaratory rulings still pending on critical VoIP questions (AT&T, Level 3, Inflexion, Vonage and SBC).

Windows CE Gets Call For Net Phones

SANTA CLARA, Calif.--Microsoft said Wednesday that major manufacturers, including NEC and LG Electronics, intend to create Internet phones with the newest version of Windows CE, Microsoft's operating system for small devices.

The first wave of phones from the equipment makers is coming over the next three months, Microsoft Product Manager Balz Wyss said.

The manufacturers are among 22 new licensees Microsoft announced Wednesday for its latest Windows CE software, which is a stripped-down version of the Windows operating system intended for handheld devices, set-top boxes and other limited-function computing devices other than PCs and servers. The new CE software, version 5, contains much improved technology for making phone calls on the Net with voice over Internet Protocol (VoIP), according to Microsoft. Internet Protocol is the most popular method of sending data from one computer to another.
