Judge Davis' decision in Vonage v. Minnesota PUC

Vonage Press ReleasesFriends of Vonage,

The attached PDF is Judge Davis' decision in Vonage v. Minnesota PUC. A summary of the document appears below:

 I. SUMMARY
This case illustrates the impact of emerging technologies evolving ahead of
the regulatory scheme intended to address them. The issue before the Court is tied to the evolution of the Internet and the expansion of its capability to transmit voice communications. Despite its continued growth and development, the Internet remains in its infancy, and is an uncharted frontier with vast unknowns left to explore. Congress has expressed a clear intent to leave the Internet free from undue regulation so that this growth and exploration may continue. Congress also differentiated between "telecommunications services," which may be regulated,
and "information services," which like the Internet, may not.
Plaintiff Vonage Holdings Corporation ("Vonage") provides a service that
permits voice communications over the Internet. The Minnesota Public Utilities Commission ("MPUC") issued an order requiring Vonage to comply with Minnesota laws that regulate telephone companies. Vonage has asked this Court to enjoin the MPUC, arguing that it provides information services, and not telecommunications services.

VoIP, Satellite Companies Join On Remote-Area Phone Service

October 15, 2003

By W. David Gardner

VoIP providers have been eyeing satellite links as a potential delivery vehicle for their voice offerings, but not much has happened. Until this week, that is when two VoIP companies -- Vonage Holdings and Net2Phone announced moves into the area.

Vonage is teaming up with SkyFrames to deliver its service to a small number of U.S. troops serving in Iraq, while Net2Phone is joining with Hughes Electronics to offer its satellite VoIP service with Africa as the initial target region.

Vonage In Print News

A pair of Internet phone providers recently signed deals to help satellite companies add Net-phoning service to their arsenal of offerings
October 14, 2003
By Ben Charny
Hughes Electronics and voice over Internet Protocol (VoIP) provider Net2Phone announced an agreement this week to combine Hughes' satellite-delivered broadband service with Net2Phone's inexpensive dialing plans, which rely on the Internet rather than a phone company's privately owned network. The two companies are first targeting broadband- and phone-starved areas in Africa.

On Tuesday, New Jersey-based VoIP provider Vonage said it has a similar-sounding project in the works with satellite broadband service provider SkyFrames. The companies plan to make their combined services available to troops in Iraq during the upcoming holidays and, according to Vonage Executive Vice President Louis Holder, "could conceivably push this service out" to a wider audience, depending on its success.

Device Promises Phone Bill Relief
October 14, 2003
By Mark Kellner

I've just hung up on a phone call to an acquaintance in the state of Kerala, in India. We talked for about 10 minutes, and the sound quality was good. The other night, I'd had a chat with another colleague in the Philippines. Again, the sound was fine.

Domestically, I've called New York, California, Illinois, Michigan and even the District, all with ease and good-to-excellent sound quality.

I didn't use regular telephone service. Instead, I used a phone connected to a small black box, which in turn was connected to my broadband router. Going through the same cable Internet service that brings e-mail and Web pages, I dialed all over the world - and received calls - bypassing the phone companies and their high charges

SkyFrames, a provider of low-cost, highly secure satellite broadband Internet services, and Vonage will provide the United States Armed Forces in Iraq with the ability to call home via broadband telephony over a wireless satellite connection during the holidays. As a result of numerous communications from military families unable to receive phone calls from their loved ones stationed in Iraq, SkyFrames sought to meet their communications need, realizing Vonage was the natural choice.
