A federal court enjoined the N.Y. PSC from imposing telecom regulation on VoIP provider Vonage until the FCC rules whether VoIP should be subject to state jurisdiction. The ruling of Judge Douglas Eaton, U.S. Dist. Court, N.Y. (Case 04 Civ. No. 4306), barred the PSC from requiring that Vonage obtain a state certificate as a competitive telecom carrier to continue serving N.Y. customers. The court indicated that if the FCC hasn't ruled on the issue by Jan., it might entertain motions to review the injunction.

Although some states have decided to not make any decisions regarding the regulation of VOIP service until the FCC has concluded its pending rulemaking on IP-enabled services, two state agencies have moved forward in their investigations of such services.

In one proceeding, the New York Public Service Commission ("NY PSC") recently concluded that VOIP provider Vonage Holding Corporation is a "telephone corporation" under New York state law. According to the NY PSC, Vonage is subject to New York's basic telecommunications statutory requirements and such state regulation is not preempted by federal law.

Vonage Wins Preliminary Injunction Against New York PSC

Magistrate Judge Douglas F. Eaton, United States District Court (Southern District of New York) announced his intention to enjoin the New York Public Service Commission (PSC) from regulating Vonage as a telecommunications carrier. The written order is expected shortly. The judge will consider the merits of a permanent injunction in January 2005.

Reinforcing Minnesota District Judge Davis' October 2003 order enjoining a similar attempt by that state to regulate Vonage, the preliminary injunction will preclude the State of New York from asserting its jurisdiction over Vonage.

Vonage Wins Another Round—For Now

Vonage Holdings Corp., the much-publicized consumer VOIP service provider, has won another, temporary round in its fight to avoid telecom regulation by the states.

On Wednesday, the U.S. District Court, Southern District of New York, overturned the New York Public Service Commission's determination regulating Vonage. Magistrate Judge Douglas Eaton will consider the merits of a permanent injunction next January.

A federal magistrate is poised to issue a preliminary injunction blocking New York officials from regulating broadband telephony upstart Vonage.

Magistrate Judge Douglas F. Eaton of the U.S. District Court announced late Wednesday his intent to rule against the New York Public Service Commission (PSC), and he is expected to release a written order shortly. He may also consider making the injunction permanent. A hearing to consider that move would likely come in January, Vonage said.
