Judge Halts NY PSC From Regulating Vonage Service

U.S. District Court Judge Douglas Eaton announced his intention to enjoin the New York State Public Service Commission from regulating Vonage Corp., a Voice over Internet Protocol (VoIP) service provider, as a telephone company, the company announced late June 30.

On May 19, the New York commission declared that Edison, N.J.-based Vonage was a telephone company as defined by state law, and ordered the company to obtain a certificate to operate in the state.

New Bill Would Place VoIP Under FCC Regulation --Aka VoIP -- Become An Interstate Service Subject To Regulation By The Federal Government Rather Than Individual States

Two members of the U.S. House of Representatives have introduced legislation that would make VoIP an interstate service.

Sponsored by Cliff Stearns (R-Florida), who chairs the Subcommittee on Commerce, and Rick Boucher (D-Virginia), who chairs the House Internet Caucus, the "Advanced Internet Communications Services Act" would place authority for VoIP regulation with the FCC rather than with the states, thus avoiding the legal question of whether it is an information or a telecom service.

Telecom: Internet Telephony Revives Split Among Telecom Firms

The battle to deregulate Internet telephone calls has
re-awakened dormant disagreements between regional Bell
companies and their telecommunications and cable industry
competitors, as each side gently presses for rival legislation to pre-empt action by state regulators.

Both sides agree that states should play a much-diminished role in regulating their industries. Internet telephone companies like Vonage have pushed for Congress to pre-empt statepublic-utilities commissions from regulating
voice-over-Internet-protocol (VoIP) services.

WASHINGTON--The political debate over how to regulate Internet phone calls is showing early signs of dividing along traditional partisan lines.

At a House of Representatives subcommittee panel hearing Wednesday, the Republican chairman struck a more cautious tone than his Democratic counterparts over what federal rules should apply to voice over Internet Protocol technology.

WASHINGTON (Reuters) - State regulators should be barred from imposing regulations on new Internet-based telephone service, otherwise they could slow growth of the nascent product, several top U.S. lawmakers said on Wednesday.

U.S. telephone carriers ranging from upstarts like Vonage Holdings Corp. to mainstays such as BellSouth Corp. (BLS.N: Quote, Profile, Research) have been deploying the service, which relies on high-speed Internet connections, in part to cut costs and boost profits.

Industry Urges Hands-Off Approach For Internet Voice Calls

Heavy regulation of phone calls made over the Internet would crimp innovation and stifle investment in the new technology, industry officials told Congress on Wednesday.

The technology, known as Voice Over Internet Protocol or VoIP, converts phone calls to data packets and sends them across high-speed Internet connections. It promises cheaper calls because it avoids some access charges associated with regular phone service.

But some states, such as Minnesota and New York, have eyed regulation of VoIP services - prompting representatives from Vonage Holdings Corp., AT&T, and other Internet voice providers to ask lawmakers to intervene.

The hearing of the House Subcommittee on Telecommunications and the Internet highlighted the varied mix of VOIP providers, which include companies that sell only VOIP as well as some cable firms and other traditional telecommunications services.
