The U.S. Dist. Court, N.Y., granted a motion for preliminary injunction filed by Vonage against the N.Y. PSC, after the Commission found Vonage was a telecom service provider subject to its jurisdiction.

Magistrate Judge Douglas Eaton said Vonage was "likely to succeed on the merits of its claim that the PSC order is preempted by federal law." It said the PSC order "will interfere with interstate commerce" and the company "will suffer irreparable harm absent injunctive relief."

Judge: Feds, Not States, Should Govern VoIP

State utility commissions can have very little control over Net phone companies, a New York federal judge wrote in an order that hands another victory to Vonage and similar upstarts.

State utility commissions will be able to work with Vonage to rectify customer complaints but won't be able to regulate or tax the company, according to U.S. District Judge Douglas Eaton.

Eaton's order, released within the past few days, strikes at the heart of a debate between federal regulators, which want to exercise a hands-off approach to voice over Internet Protocol (VoIP) to let the young industry grow, and states, which rely on tax revenues to pay for public programs.

After years of waiting and hoping for the technology to take off, VoIP services are now gaining momentum in the U.S. marketplace.

Residential VoIP service providers such as Vonage are adding nearly 20,000 new lines a month and other services such as AT&T’s CallVantage aim to have 1 million subscribers by the end of 2005. In July, Vonage activated its 200,000th line.

Federal Judge Tells New York PSC It Can't Regulate, Tax VoIP Providers

A federal judge has ruled that the New York State Public Service Commission can work with Voice over Internet Protocol (VoIP) service provider Vonage in resolving customer complaints and quality of service issues, but the state commission cannot regulate or tax the service provider.

A New Kind Of States' Rights

For more than a century, most telecom regulation has come from the states. That changed somewhat with the passage of the 1996 Telecommunications Act, which granted the FCC greater powers.

Still, states continued to play a key role in the voice-calling arena, particularly after the FCC released its Triennial Review Order last year. Key components of the TRO called for state commissions to oversee detailed studies of the telecom marketplace and determine where CLECs were impaired. The aggressive, nine-month timeline created mountains of work for state commission staff members, but the TRO represented a high watermark for state commissions' authority.

Recent acceleration in the popularity of voice-over-IP services has lit a fire under lawmakers to define IP telephony's place within the larger scheme of telecommunications regulation. But there remains considerable disagreement in Congress over the roles federal and state regulators should play.

Two years ago, Allen Tsong had just about had enough. Tired of paying $50 a month for a local phone line from Verizon that he rarely used, he canceled the service and ordered a voice-over-Internet phone from Vonage, a start-up that entered the market two years ago. He has never looked back.

To start his service, Mr. Tsong, who lives in Brooklyn, attached an ordinary phone to a paperback-sized adapter that can send his calls over high-speed Internet connections. The biggest draw was the price: Mr. Tsong spends $15 a month for 500 minutes of calls anywhere in the United States or Canada, and speaks to family and colleagues in China for pennies a minute.

Calling All Phone Sites

The Internet phone industry got a couple of boosts last week.

At one end of the emerging market for online calling, freebie pioneer Skype Technologies (www.skype.com) announced it will launch a new service this week allowing Skype users to call anywhere in the world at rates mostly under 2 cents a minute.

At the other end of this fiercely competitive new business, heavyweight Verizon Communications jumped in to offer unlimited Internet calling to anywhere in the United States for $39.95 a month. (www.verizon.com/voicewing) Verizon is offering a $5 monthly discount for the first six months; customers of its DSL service get $5 more off their bills during and after that promotional period.
