At the end of 2003, the broadband situation in Ireland was not good. The Republic lagged in broadband take-up compared to most of the developed world, and Eircom-bashers insisted that the incumbent was to blame. A full 12 months later, the key industry metrics have risen, but the rhetoric is much the same.

In 2004, most talk of telecoms in the Irish market revolved around one issue: the rollout of ADSL, or broadband internet over the copper wires going to most homes and businesses. On an almost monthly basis, a new report from a government advisory body, the EU, a research firm or an industry group would hammer home the same message: most of the developed world leads Ireland by a wide margin in terms of broadband rollout and take-up -- a mantra that had been repeated in certain circles throughout 2003 and 2002.

As Canada's telecommunications regulator heads into 2005, it faces a litany of challenges at a time when the $32-billion industry is poised to go through extraordinary change.

Among the most pressing issues the Canadian Radio-television and Telecommunications Commission must address are whether/how to regulate Internet telephony; finding a replacement for David Colville, who retired recently as vice-chair, telecom; dealing with a heavy backlog of regulatory decisions and applications; and the start of a the next price-cap regime.

Vonage, a provider of telephone service via the Internet, scored a significant victory this week when a federal court ruled the state of Minnesota cannot regulate it as a regular telephone company.

"Vonage is extremely pleased with the victory,” the company said in a statement provided to Local tech Wire. “The 8th Circuit federal appeals court has granted us a permanent injunction against the Minnesota Public Utilities Commission's order regulating Vonage as it would a monopoly wireline phone company.

Dayton Gains Broadband Provider

A New Jersey company, Vonage Holdings Corp., announced Tuesday it will begin offering broadband telephone service in the Dayton area.

The local service is part of the company's recent expansion in Ohio, according to a news release from Vonage. The service includes free unlimited local and long distance calling.

Vonage's calling plans range in price from $14.99 per month to $49.99 per month and is being made available to both residential and small business customers.

Appeals Court Rules VoIP Can't Be Regulated

The efforts of VoIP providers to keep individual states from regulating their services received another boost Tuesday, when an appeals court agreed with a lower court decision that ruled VoIP is a data service and, as such, can't be regulated by states.

The two-page decision was issued by the U.S. Court of Appeals for the Eighth Circuit in St. Louis. The original decision in support of VoIP provider Vonage was issued in October of 2003 by Federal District Court Judge Michael J. Davis, after the Minnesota Public Utilities Commission (PUC) told Vonage it would have to pony up fees to support the state's 911 services. The PUC also told Vonage it would be required to obtain telephony company business licenses to do business as a telephone operator in Minnesota.

Vonage said its donation of free phone service to the U.S. military in Iraq and Afghanistan has allowed soldiers to make over 200,000 phone calls, spending more than 2 million min. on the phone with loved ones in the U.S. It said it planned to continue the program through 2005. Separately, Vonage said it would offer its VoIP service in Me. and Tucson, Ariz.

Court Bars Regulation of Web Phone Service

A federal appeals court upheld a lower court ruling yesterday that prohibits the state of Minnesota from regulating Internet-based phone calling as if it were a traditional telecommunications service.

The ruling by the United States Court of Appeals for the Eighth Circuit in St. Louis, in an appeal brought by the Minnesota Public Utilities Commission, is a victory for companies like Vonage that provide phone calls over the Internet. Those companies have argued that they are different from traditional telecommunications providers, in part because they supply the computer software used to make and receive calls but do not own and operate the physical network that carries the calls.
