California Withdraws Voice Over Internet Protocol Appeal While Debate Regarding 911 Service May Trigger FCC Action

The California Public Utilities Commission withdrew its appeal of the FCC’s 2004 Vonage decision preempting state regulation of Voice over Internet Protocol ("VoIP") service. The CPUC was the first state commission to appeal the FCC’s decision. In a three-to-one vote, the CPUC decided to withdraw the appeal during a closed meeting.

CPUC President Michael Peevey stated that he voted to withdraw the appeal because it was a "loser issue" and that VoIP is "obviously" an interstate service. The lone dissenter, CPUC Commissioner Geoffrey Brown, stated that the CPUC was "abdicating to the FCC the control we have in telecom." California consumer groups objected to the decision, arguing that the agency favored the communications industry over consumers. The CPUC’s decision may lead other states to withdraw their appeals, all of which were consolidated before the 9th Circuit Court of Appeals.

As reported in last month’s Bulletin, Voice over Internet protocol provider Vonage Holdings Corporation ("Vonage") has complained that incumbent local carriers are rebuffing its requests for access to selective routers that connect directly to emergency call operators that would allow Vonage to provide emergency 911 ("911") service. Some incumbents defended their position by saying they preferred to focus on industry-wide solutions. The FCC Wireline Bureau subsequently met with representatives of the Bell Operating Companies on this issue, although the staff would not comment on the meetings. It now appears that Vonage is making headway with numerous incumbent carriers.

US Broadband Giant Bids For Mainstream UK Reach

Vonage, North America's biggest broadband communications company, is employing a mass-market media strategy as it launches into UK high-street chains.

Vonage's broadband-delivered telephone service has been available to UK consumers since January, but the US firm is currently in negotiations with high-street consumer electronics chains to establish a retail presence by June.

It will aim to gain coverage outside the technology pages of the nationals and consumer lifestyle media, to reach a broader audience.

'This is not a product for geeks. It's a product for the general domestic market. It's a consumer product, not a computer product,' said Roger Nelson, joint MD of Nelson Bostock, which has been hired to handle PR for Vonage's entry into the UK.

What is in The Great American Songbook?

Every so often, one of the major artists will issue an album titled (in this case), "Ella Fitzgerald sings the Great American Songbook." Those of us who have been around a while don't need to know what's in it. We don't even need to know what the great American songbook is. It's the several hundred songs that are still around, from the moment they made their debut in, most likely, a Broadway show or a Hollywood movie. Think of, "In the Still of the Night," as one example. "I'm Beginning To See The Light," as another.

You get the idea. The great songs that never lose their brilliance, that are never far from our ears. These are the songs we write about here when we do a column about commercials and the music that's used to underscore them: "Blue Skies," "As Times Goes By," "It Had To Be You," and "The Nearness of You."

But, now that I think of it, Vonage is using one of the great favorites of my later teen years, "Woo Hoo," originally performed by a Swedish band, the Rocketeens.

Vonage Raises $200M

In March, Deal Flow told you that privately held broadband phone company Vonage Holdings Corp. was raising $100 million in its fifth round of funding. Turns out the company managed to raise twice that amount. Tomorrow, Vonage will close a $200 million round led by Bain Capital with participation from the company's management and previous investors 3i Group, New Enterprise Associates, Meritech Capital, and Institutional Venture Partners.

That's the largest VC funding on record this year, according to researcher VentureOne. A source says Vonage is valued at approximately $1.1 billion after the financing. (Vonage wouldn't comment on valuation.)

Including the new round, Vonage has raised about $410 million since it was founded in 2001. Just nine months ago, it closed a $105 million round, much of which is still in the bank, says CFO John Rego. Why raise more? "Growth, growth, and more growth," Rego says.

Vonage Holdings Corp. said Thursday it has raised $200 million in a late-stage round of venture capital, helping strengthen the company in its bid to lead the market for voice-over-Internet telephone services.

It was the largest venture capital investment this year and made Vonage one of the most heavily venture-backed companies around.

Vonage, which is based in Edison, has now raised more than $400 million in funding, and the latest capital infusion comes just nine months after the company raised $105 million in a round led by New Enterprise Associates, which is based in Menlo Park, Calif.

This time Boston venture capital firm Bain Capital Inc. joined Vonage's group of investors, leading the round from its $250 million venture capital fund. Earlier investors New Enterprise Associates, 3i Corp., Meritech Capital Partners and Institutional Venture Partners also participated.

The round will help the Internet telephony company expand. After launching in Canada last spring and in Britain just three months ago, Vonage is making Asia Pacific its next target.

Vonage Holdings Corp. said it raised $200 million in a late-stage round of venture capital, an investment that gives the company some ammunition in its bid to lead the market for voice-over-Internet telephone services.

Vonage , based in Edison, N.J., has now raised more than $400 million in funding. Boston venture-capital firm Bain Capital Inc. led the current round, which will help the pure-play VOIP provider to expand further in the U.S.

While Vonage has established itself as one of the largest players in the market, it faces stiff competition from big carriers and cable operators hoping to stake their own claims.

A big shortcoming of most Internet-based phone services — the lack of full-featured 911 service — is expected to be remedied this year as providers, regulators and local phone companies quickly coalesce to resolve the growing public-safety hazard.

Federal Communications Commission Chairman Kevin Martin is recommending that Net-based phone companies be required to offer the full-featured service, called Enhanced 911, or E-911, by fall, three FCC officials told USA TODAY.

Commissioners are expected to approve the proposals later this month.

At the same time, after a two-year stalemate, the regional Bells are agreeing to provide Internet phone companies access to their E-911 systems to help them offer the emergency service.

The flurry of activity comes amid cries for action by Congress after several high-profile incidents in which customers of the so-called Voice-over-Internet-Protocol services could not reach 911 operators. As a result, several states are suing, or considering suing, the No. 1 VoIP provider, Vonage.

Low-priced VoIP services allow voice calls to travel over broadband lines. About 1.5 million VoIP customers get their service from cable companies that provide E-911, research firm IDC says.

The Series E round, the largest venture capital investment this year, makes Vonage one of the most heavily venture-backed companies around. Edison, N.J.-based Vonage has now raised more than $400 million in funding, and the latest capital infusion comes just nine months after the company raised $105 million in its Series D round, led by Menlo Park, Calif.-based firm New Enterprise Associates.
