Last time I checked, it was legal to do so in NY. (without knowledge of the other person). I believe several other states also allow this as well.

I record calls on Vonage all the time. I work in market research and need to record interviews I conduct over the telephone. Any device that can record a telephone conversation can record a Vonage call off of the same wiring set-up. I use a foot-pedal operated tape machine that is hooked to a little device from Radio Shack that connects between the wall outlet (or the Vonage gateway) and the phone, and it causes the phone to automatically control the recording -- I pick up the phone and it starts recording, I hang up and it stops.

Recording conversations to which you are not a party without the other person's knowledge is illegal in most places. Recording conversations to which you are a party is legal even without the other party's knowledge in some but not all states. In any event you don't need the other person's consent, they just have to be aware of the recording (if someone continues in a conversation that they know is being recorded then consent is implied).

Is it legal to record telephone conversations?
While we can't give legal advice, it is generally legal to record conversations as long at least one person on the line knows the call is being recorded, unless the recording is to be used in court.
if you want to use your telephone recordings for legal purposes you should Consult an attorney for the requirements in your state.

Federal law allows recording of phone calls and other electronic communications with the consent of at least one party to the call. A majority of the states and territories have adopted wiretapping statutes based on the federal law, although most have also extended the law to cover in-person conversations.
Thirty-eight states and the District of Columbia permit individuals to record conversations to which they are a party without informing the other parties that they are doing so. These laws are referred to as "one-party consent" statutes, and as long as you are a party to the conversation, it is legal for you to record it. (Nevada also has a one-party consent statute, but the state Supreme Court has interpreted it as an all-party rule.)

Twelve states require, under most circumstances, the consent of all parties to a conversation.
Those jurisdictions are California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington.
Be aware that you will sometimes hear these referred to inaccurately as "two-party consent" laws. If there are more than two people involved in the conversation, all must consent to the taping.

You are correct, in IL it is illegal to record without both parties knowing. In fact, it is a felony.

Im pretty sure Express Talk VoIP Softphone allows you to record your phone calls no matter which SIP provider you use.
