Post subject: Texas suing Vonage over 911 calls
State to sue Net phone company
11:21 PM CST on Monday, March 21, 2005

Texas Attorney General Greg Abbott will announce today that he is suing a leading Internet phone company that didn't connect a 911 call last month in Houston.
The case alleges the company violated the state's deceptive trade practices act. Federal and state policy-makers are talking about requiring Internet-based phone services to provide 911 service.

is not sufficiently warning prospective customers about limitations of

Sprry, but upon signing up for
vonage
there are numerous emails and pages you will be taken to that say you must sign up for 911 dialing .. and here's the kicker.
It is CLEARLY stated in the terms of service that no one bothers to read. But is that
vonage
's fault? Certianly not. This case will go no where.

According to the article, the AG's argument is that cases of failed 911 attempts are proof in and of themselves that the warnings aren't sufficient.

Terms of Service ---- The 911 Dialing part is about 2 pages long, but here basically it says 911 is not garanteed to work.
Due to the technical constraints on the manner in which it is possible to provide the 911 dialing feature for
Vonage
Service at this time, you acknowledge and understand that there is a greater possibility of network congestion and/or reduced speed in the routing of a 911 communication made utilizing your
Vonage
equipment as compared to traditional 911 dialing over traditional public telephone networks. You acknowledge and understand that 911 dialing from your
Vonage
equipment will be routed to the general telephone number for the local emergency service provider (which may not be answered outside business hours), and will not be routed to the 911 dispatcher(s) who are specifically designated to receive incoming 911 calls at such local provider's facilities when such calls are routed using traditional 911 dialing. You acknowledge and understand that there may be a greater possibility that the general telephone number for the local emergency service provider will produce a busy signal or will take longer to answer, as compared to those 911 calls routed to the 911 dispatcher(s) who are specifically designated to receive incoming 911 calls using traditional 911 dialing. You acknowledge and accept that

relies on third parties for the forwarding of information underlying such routing, and accordingly

The cases of people trying to dial 911 when they have not activated it with
Vonage
(as in the Houston case, AFAIK) and this lawsuit are proof some people are just not willing to take personal responsibility for their own security.

I suspect that the case will result in
Vonage
being forced to put a sticker on the adapter warning of 911 issues and including stickers in the package for customers to place on telephones.
This is standard consumer protection type stuff. "Warning the beverage you are about to drink may be very hot."

In 1900 only 10.7 percent of the public could not read or write a simple message. By 1993 such functional illiterates were estimated to be 21% of the population.
Maybe this was a factor?
