If your little sister couldn't read at the time, then the beating would be justified. Don't blame someone else because you were too lazy to read the fine print before you signed up. It's there in black and white and it's clearly worded. Face it, you clicked past the ToS and didn't read it, just like most of us do when we sign up for these kinds of services, and now you've gotten burned by it. Just send it back and be done with it.

I would say my point still holds. The fact that you accept this being done to you says something about your constitution.

It says that I took the time to read the ToS and while I wish this clause wasn't there, I chose to do business with them. The policy is stated... twice in fact, in the ToS. If you didn't like it, you should have chose to not sign up for the service. Nobody forced you into this. You didn't do your homework and now you're bitter about it. That says something about your character. You screwed up. Own up to it and move on.

No, I won't. Flat out. I got screwed, i'm gonna have to deal with it. But that doesn't make it right. Hell, it may fall under false advertising, which I will look into.

If it had said Free* I would understand. But it said Free. Where I come from Free means no cost to me in any way.

This falls outside normal business practices. No one can dispute that.

It's semantics at this I guess. They aren't charging you for the equipment. They are charging you a disconnect fee, which is very common on the telecom industry. I do understand how it seems underhanded to you. I'll even agree with you that it seems a bit shifty. But the fact is that the policy is clearly documented... twice. Any claims they make about the service are further defined in the terms of service. You signed off on them when you signed up.

Here is another example. Go to Nextel.com. Click on Phones and Rate Plans. You can get a phone for 99 cents. Wow! What a deal. Then read the fine print. You must sign up for 2 years or pay a $200 termination fee. So, in reality, that stinking phone costs me $200.99.

The concern I have is the clause in the ToS that says the equipment must be returned "in it's original packaging". That leaves a lot of leeway for them to get out of it. I can see this response:

"Sorry pal, you forgot the rubber band that held the plastic bag closed that the network cable came in. That will be 39.99 please."

I don't know that this would happen, but it is a bit of a concern for me. I'd be interested in hearing from people that have returned their equipment to see just how picky Vonage is about this. Then again, if they returned their equipment they won't be around this forum to comment on the question.

I've seen many posts that comment on speedy credits for shipping the device back. it probably has the most overall positive cust. service stories I've read.

Many of my electronic components were damaged during a thunderstorm here on June 16th. The Vonage ATA was shot along with Airport Wireless, a TV, cordless phone, etc. I had it replaced for $99.95 and Vonage sent the Motorola VT1005V unit instead of another ATA.

I only wonder if Vonage will want THIS equipment back if I were to disconnect (which isn't likely.) I would still be out about $60.00!

I WILL watch out for electrical storms and be more diligent in protecting my equipment.

Just my thoughts, In lieu of a disconnect fee, you have a choice to return your Vonage equipment.

If you wish to keep the equipment, than its ok with them.

I wonder if the Vonage equipment is still "locked" and therefore, not usable with another Voip.

I use a APC Back-ups 750. Quite a nice unit I must say. Lot's of ports, power, and has phone and coax protection too.

If you think of it that way, then I can see why the guy that started the thread had such an issue with the charge. They advertise it as FREE. If you're going to charge me for it when I disconnect, then it isn't free. Instead, I think of it as a disconnect fee and they are willing to buy the equipment back from me which they gave me for signing up. Then the model works. As I said, it's all semantics at this point.
