Rule #1, now that you have isolated the problem specifically to your isp (Charter), never tell them that you're using a Voip service...they will use that information against you as they already have done in wanting you to contact Vonage to fix their (Charter) problem. Next time you call them DO NOT mention Vonage at all, tell them you're having trouble with online gaming and the connection drops in-and-out after 8PM. Maybe Charter is doing some type of line work in your area at the times you experience disconnects. Everytime your modem drops off, Charter can see this from their end and should be able to correct this if it's not the modem itself which I would tend to doubt since you say the disconnects only happen at night.

How old is your cable modem and whats the make and model?

yea i get that now, as soon as the tech said that i was like...ok now i know they just don't want to deal with it. and as far as how old this modem is, umm, i have no clue exactly but this is the same modem i got with my service when i first got high speed so i would say 4 years? when i changed to my new speed recently they sent a tech out to check the modem and he said it was fine and that he would even prefer this one over their new ones. (of course first thought that popped in my head was, ok you just don't want to give me a new one)

it is a Motorola SB4101 SURFboard cable modem.

What are your modems signal levels? Is the cable line going to your modem split? Type, 192.168.100.1 into your web browser and post back your downstream and upstream signal levels. With your modem being 4 years old, it might be time to replace it...just maybe.

the cable line comes right from outside into a splitter, one goes to tv the other to my modem.

Your modem's signal levels are very good to excellent even with the split cable...so I don't believe the modem is the issue. You say the disconnects only happen at night, have you ever noticed it disconnecting during the day? Ask Charter to monitor your line for drops with your internet signal. When the signal does drop, does it automatically come back online or do you have to reboot the cable modem?

not at all, works fine all day long, no slow downs at all. for the past five nights it is now, little after 8pm est, i notice a slow down, then it will disconnect me a few minutes after, even if i don't unplug or reboot it will still come on by itself but for 1-4 hours it will cut in and out and during that time when its working it goes very slow, so i just have to wait for it to completely pass.

You're using a router right? Did you secure it? If your router is not secure, someone could be leeching off your line which could explain the slowdowns you are experiencing but not necessarily the disconnects.

You are going to have to get Charter to your monitor your line for the drops in connection. Does your cable TV signal also drop when the internet signal drops? Everytime your modem goes offline, Charter can see the drop in connection. It may be a line issue, whatever it is, it's their problem to fix not Vonage.

i don't use the router anymore, i thought that might have been the cause of me breaking up on the phone so i stopped using it, i just have my cable modem and Vonage adapter. and yea im just gonna call a tech there and not mention Vonage at all.

Call them when the internet signal drops. That way, they can definitely see that the modem is offline.
