PostPosted: Sun Apr 08, 2007 6:14 pm    Post subject: State taxes on fees ??? Reply with quote Back to top

AFAIK, they are supposed to charge sales taxes (I'm in NJ) on 'service and equipment'.

After realizing that the Int'l rates are now lower than the old calling cards I used to use, specially when those bastards started to charge access and service fees, I decided to check what I'm 'really paying'.

Looking at my bill, I find that they are charging $1.89 in sales tax. The service plan is $24.99 and at a tax rate of 7%, it should be $1.75. Making some numbers, I notice that they charge tax on the Regulatory Recovery Fee ($0.99) and Emergency 911 Cost Recovery ($0.99).

Bottom line, are they 'eating' this $0.14 cent charge on every customer in NJ ? How can they charge taxes on fees ?

I sent a letter but I know what their answer would be...

TIA

They also charged me sales tax on shipping. I don't think shippining is taxable in PA, but I could be wrong.

Or you could move to the UK, get ripped off more and pay 17.5% VAT on most things.

Note that the two items in the first post aren't taxes (although they may appear to be from their description) - they are fees charged by Vonage above the monthly rate. Not surprising that the state taxes apply to the fees - they are part of Vonage's cost of doing business that Vonage has elected to itemize to the customer rather than accounting for under the monthly rate.

Consider if Vonage charge a $1.00 rate for unlimited calling but then added a $24 "subscriber fee" - absurd example, perhaps, but it illustrates why the state feels it is entitled to the tax on fees.

Here in PA I don't pay any state taxes on Vonage, BTW.

State taxes aren't the only thing. I've seen a few posts here over the past few months that also include State, County, and Local taxes too, depends on your part of the country.

If you're in Manhattan for example, you're going to get hit with a lot more taxes than in East Bumble, KY for example.

Yes, those are 'fees' and not taxes. But the thing is that AFAIK, you can only charge sales tax on service and equipment. These fees are neither. Still they are collecting sales tax on that. I'm wondering if that is being passed down to the states, or simply they are just profiting from it...
