Malicious prosecution to punish only Vonage viz Verizon?

Can Vonage counter sue Verizon for malicious prosecution? Vonage is being punished by Verizion for using technology that other VoIP companies are allegedly also using. Is there some sort of collusion? If Comcast and other VoIP companies use similar technology, is it discriminatory to target only Vonage, while others companies are allowed to continue?

Could this be a price fixing collusion to sink Vonage because it offered a good phone service for much less than the telcos or Comcast?

The point about this Verizon/Vonage case is that the wrong people are in court. The US Patent Office should be the one in front of the judge for maladministration in the granting of so many dumb patents to oganisations without proper investigation of the background of the claims.
It is the consumers who are suffering here as a consequence.
