ALEXANDRIA, Va.--A federal judge on Friday ordered Vonage not to accept any new customers while it continues to infringe on Verizon Communications patents covering some aspects of Internet phone calls.
In at least a temporary setback for the leading voice over Internet Protocol provider and its some 2.2 million subscribers, U.S. District Judge Claude Hilton said it was the only fair option that would minimize harm to both companies for now.

Hilton did not offer either side a chance to make any additional arguments during Friday's hearing, which lasted about an hour. "You have every right to go to the court of appeals," he told Vonage's attorneys. "They might have something different to say."


Roger Warin, Vonage's attorney, protested Hilton's no-new-customers order. He compared it to "cutting off the oxygen as opposed to a bullet to the head."

He also told Hilton that in effect, "what you are doing is slowly strangling Vonage because it cannot preserve that customer base" indefinitely. He noted that Vonage's customer turnover rate is 2.5 percent per month.

In its original court complaint filed in June 2006, Verizon accused its growing rival of infringing on seven of its patents, but it later scaled back the scope to include only five patents.

Vonage has maintained that it did not infringe on any of the Verizon patents and that its service rests on commercial, off-the-shelf technology.

The company has also said that even if the verdict is upheld, its subscribers will not encounter disruptions because it is developing a technological workaround.

But it's unclear how far along Vonage is in that process. In a recent government filing, the company reported signing a licensing agreement with a Voip wholesaler that appeared to provide a replacement for two of the Verizon-patented technologies. Vonage said Thursday that the deal actually has nothing to with its patent woes.

I am in Green Bay 920 as well and have had several calls this morning w/ caller ID, but no communications. It seem as though they cannot leave voicemail as well.

We can't call anywhere on Vonage...and their site is dying....I think you better make sure the management stays in the country... See you all on the Comcast Voip site..in the near future....

I'm in West Allis, WI (area code 262 number though) ... this appears to be a similar problem that we were experiencing on Wednesday. The problem then seemed to be connecting calls from the PSTN to the Vonage network. Vonage to Vonage calls were completed, and Vonage to PSTN calls were connected, but not PSTN to Vonage.

I've tried to connect to the Vonage website, and all I receive after logging in is a status message saying sorry we're currently unavailable due to upgrades...

I'm a loyal customer, and a fairly happy one at that... This is horrible timing for Vonage as it only makes the service look worse than it really is.

I have to say, though, with my wife and son at home, and being potentially unable to reach them is COMPLETELY unacceptable.

Can we get a sticky to keep track of the area codes being effected, I don't think its the entire service, but probably select markets...

I do not see things as that desperate. I have been a long term investor in stocks. There is no way this company will just go away. At the worst it will be bought by another provider. Perhaps even a Verizon type company.

A 2 million customer base is just too good for anyone to pass up. Trust me Vonage will be around in some form or another for a long time.

I am in Stevens Point (715). Same issue being experienced in Green Bay. I did get a couple of calls earlier today but now phone rings but no one is n other end of line. Interestingly, I tried calling my home phone from my cell phone several time. The cell phone indicated that the call was unsuccessful but about 5 minutes later, the Vonage phone rang with caller ID indicating it wa my cell phone. Obviously noone was on the line.

Plus I just got a call from some guy asking why I was calling his number from my cell phone. For some reason the calls to my Vonage number from my cell phone were going to his phone.

More months things have been relatively ok. Over the last few weeks things have be gettng worse. I can typically hear the incoming call but my voice is garbled going out, often so badly that I can be understood by the caller.

I honestly couldn't care less about the stocks. I'm concerned about the service itself. Quite honestly, I do see Vonage going away. Verizon already said that they don't want to buy Vonage, nor do they want to license the patent (has anyone actually been able to find a patent reference) ... Further, a 3rd party company is probably not interested in picking up the baggage for the suit.

Verizon, IMO, is using this to crush the competition. Verizon has taken this as far as they can, and won. They even denied a previous attempt by Vonage techs to change the system, saying that it was still too similar to what Verizon's patents cover.

This whole patent suit has been far to vague to be valid, can anyone discuss the patents themselves to the point of sharing what it was (specifically) that Vonage infringed?

In the same boat as you jofficer. In Milwaukee (414), the wife is home with the kids and no real way to get ahold of them if needed.

Hopefully they'll get this straightened out soon.

Finally got a tech on the line. He reported that a server(s) is out, which is causing the calls not to be routed to the appropriate ATA, and basically in effect saying that these numbers (According to the Vonage system) aren't active/valid. The issue would seem then to be at the perimeter of the Vonage PSTN network, as opposed to something heavily internal, as all Vonage to PSTN and Vonage to Vonage calls are still working.

Anyone else care to elaborate?
