You are the stupid one. When terms are conflicting it is ambiguous as to which one controls. Obviously the shareholders will say one will control and the evil underwriters will say the other will. Vonage has NO standing to sue. The only recourse is arbitration. And I will be very happy to go to an arbitrator and state my case. I will admit, however, that if the arbitrator rules against me (after hearing my case --- remember noone is hearing our cases yet), I will pay. that is a fair thing to do.

I am still flabbergasted as to why people rely so much on a few words to say you agreed so you must pay. If that were the case there would not be any need for lawyers and/or courts. But there are plenty of lawyers and plenty of businesses enter into agreements then only interpret the facts differently and not "pay." WHY IS THAT ANY DIFFERENT??

I think its funny that if the stock went up, nobody would be complaining. myself included.

Vonage really screwed themselves on this one, but even if they lose all 10,000 subscribers that bought stock (unrealistic), they still have over 1.6 million, they aren't going to shed too many tears.

I joined the class actions as well, mainly due to I think they handled it piss poor, with the whole zero allocation crap.. cost me some cash since I didn't know I had any till I needed to pay.. oh well..... we'll see what happens.

Ok. So, thousands of us "reneg-ers" go to arbitration. I wonder exaclty how many of us there actually are. So then we, who now completed our alleged obligations to purchase 13.5% of the company become....wait for it OWNERS OF 13.5% of the company. I wonder if we could then exercise any corporate rights, perhpas call for no confidence votes or have corporate directors dismissed for cause. If there are that many of us out there, something to consider.

Probably not much since we are still the minority. The worst case scenario at this point is that we will need to pay the 5 bucks or so a share. But if that happens, Vonage will lose me as a customer.

I have participated in FIVE other DSPs. And EACH ONE there was the opportunity to reconfirm. This negative consent crap is for the birds.
