Depends on what RR you are using. Here in Houston, you must get your modem from Time Warner. They will trade it for you for free, so it isn't a big deal. Just bundle up your old one, walk into a retail store front, and walk out with a new modem (they do the same thing with cable boxes). Some RRs do let you provision your own modem, but some don't.

I think my RR is basically the same provider that you have...both have "houston" in the domain...probably have the same policies...

So, how would I have any control of exactly which brand/model of modem that I get? Are you thinking that newer is better, regardless of brand/model?

Yeah, as far as I know they will have all of the same modems at any given time. Several people I know just did the same thing (on my advice) and we all got Ambit modems. They aren't marked as such, but that's what they are (they aren't marked at all). You can view the configuration screen though and see that they are Ambit.

But yes, I would say anthing other than the Toshiba would be a good bet.
I'm down in League City and made the trade at their retail front on Nasa Road 1, but from what I gather you can do it at any of the retail fronts. If there is any doubt call them first and ask if the retail front you want to use has cable modems to trade out. When I first got RR I had to drive to Belaire to pick up a self-install kit but as far as I know they all have that kind of stuff now.

I called the local office and they are still using the same modem that I have now, so no joy on that idea...

That's odd. I would think they all used the same ones and several of us were given Ambit modems. I wonder if there is any chance they were mistaken? Who told you the modem would be the same? Are you sure you have a Toshiba? My Toshiba was a vertical standing gray box. The new modem looks like a regular phone modem, low and wide. Much smaller too.

I was told that the modem I have now is the current (and newest) one. It is a vertical gadget with "Toshiba" on the front of it.

If I could go for something that is known to be superior to what I have now, I would get all over that, but I must admit that I am reluctant to try the luck of the draw...the modem I have now seems to be working pretty well, and with my luck, whatever I get next time might turn out to be worse!
