Welcome to today's edition of the Vonage Voip Forum Digest. 

First and foremost, we'll catch up on key news about Verizon's patent suit against Vonage, as well as reexamine Vonage's side in yesterday's court decision about SprintNextel's infringement lawsuit against Vonage. Then we'll go straight to two Vonage Forum threads, one about what Vonage told a Vonage Forum Member about the maximum length of Vonage calls,  and the other is concerned with a call quality issue. We'll also check in on Vonage's stock price.



In The News

Vonage Receives a Break In Verizon Patent Suit Dispute

Vonage announced today that the U.S. Court of Appeals for the Federal Circuit today partially remanded a March 8th jury verdict in the U.S. District Court in Alexandria, Va. that the company infringed on three Verizon patents. The U.S. Court of Appeals for the Federal Circuit remanded the infringement verdict on the 880 patent and affirmed the verdict on the 574 and 711 patents. Further, the Court of Appeals vacated the entire award of $58 million in damages and the 5.5% royalty. The Court of Appeals remanded the case to the U.S. District Court and directed that the court retry those aspects of the original case.

In light of the workaround technology that Vonage has developed and deployed, today's decision is not expected to have an adverse impact on Vonage's business and customers will continue to enjoy the same great service they have come to expect from Vonage. Workarounds to the 711 patent and the 574 patent have been deployed for awhile.

"We thank the appellate court for its thoughtful consideration of the merits of our case," said Vonage's Chief Legal Officer, Sharon O'Leary. "We are pleased with the decision to vacate the 880 patent and the damages. However, Vonage remains confident that it has not infringed on the 880 patent -- a position we will continue to vigorously assert and look forward to presenting at trial."

O'Leary continued, "In the meantime, it's business as usual. We have had our workarounds for the 711 and 574 patents in place for some time and will remain focused on providing a great customer experience."

Vonage To Appeal Court Decision

This news broke yesterday afternoon, but it is so important I thought I would update it and then repeat it.

Vonage announced that it will seek to overturn yesterday's U.S. District Court jury verdict in a patent infringement lawsuit brought by Sprint Communications Company L.P. and continue focusing on providing reliable, quality digital phone service.

Federal court jurors in Kansas City, Kansas ruled in favor of Sprint, finding that Vonage had willfully infringed Sprint's patents in providing its Voip telephony services, and awarding $69.5 million in damages, which the jury found to be five percent of Vonage's revenues over the infringing period. Vonage will ask the court to set aside the verdict, and if it is not granted, will vigorously pursue an appeal of the decision, including the underlying issue of liability and the willfulness aspect. Vonage believes any damages awarded are inappropriate. In addition, we will seek to develop technological workarounds that don't infringe on Sprint's patents.

"We are disappointed that the jury did not recognize that our technology differs from that of Sprint's patents," said Sharon O'Leary, chief legal officer for Vonage. "Our top priority is to provide high-quality, reliable digital phone service to our customers. Vonage has already demonstrated that it can keep its focus on customers and on its core business while managing ongoing litigation," she added.

On The Vonage Voip Forum

Vonage Forum Member cosmos decides to open a Vonage Forum thread that asks the question, call disconnects if it hits duration of 4 hours ?

In the post he made to start his thread, cosmos states his issue and then pastes in a reply he got from Vonage.

"Anyone else run into this ? Its been very consistent about disconnecting any call at exactly 4 hours. btw using Motorola VT2442 for roughly a year now, cosmos writes.

 Here was the reply from Vonage customer care: 

"Thank you for choosing Vonage, the #1 rated digital phone service! I understand your call disconnects if it hits duration of 4 hours. I apologize for the inconvenience caused. I would like to inform you that the maximum duration that a call can last is 4 hours. Then you need to redial if you would like to continue the call. This is because every session that is created by dialing a number is designed to last for 4 hours in the software design that works for the Vonage service.

To that post, Vonage Forum Member houuser posted this:

"Four hours has been the norm for a long time," writes houuser.

"The reason I have been told is to make sure the telephone (service) is not used to monitor (such as a baby monitor while you are at work)," adds houuser, who by the way has been a Vonage Forum Member for more than four years now. That's longer than almost any other active Vonage Forum Member.

Recipient has poor reception but only when I call out is a new Vonage Forum thread which has been established by Vonage Forum Member myxobolus.

For his thread-opening post, myxobolus includes his Vonage test results. They are:

7. When someone calls me the connection is fine both ways. However, when I call someone the line is choppy, broken, and intermittent on their end. I would guess the recipient can hear approximately 75% of the conversation. I (the caller) can hear them just fine. I've tried 3 different routers and 2 different cable modems but too no avail. Please help!

Vonage Forum Member Darrell_G, who has been very active and helpful here on the Vonage Forum, reads these test results and then makes a follow-up post in which he writes: 

"Your test results are very good and nothing can be deemed from your results as what's causing the issue you're having. When you make an outbound call, are you running anything in the background, i.e. P2P file sharing or the like that may be causing the choppy audio? Do you have a friend or neighbor that has a broadband connection that would allow you to test your PAP2 with their connection? If at all possible, that's the first thing I would try."

Vonage Stock Report

Today on the New York Stock Exchange, Vonage stock trading was still affected by the patent decision. Vonage stock closed at 96 cents a share, down 34 cents (-26.15%)  from Tuesday's ultimate final  $1.30 a share close but then again, that closing price was seven cents higher than today's lowest Vonage stock price and that was 89 cents a share. Reflecting a huge number of activity, total Vonage shares traded on today climbed up to a total of 12,391,500 shares.
