Madison River Communications Corp., a regional phone company with customers in eight states, has attracted national attention as the first carrier penalized for blocking customers from using its network to make cheap long-distance calls using the Internet.

Last week, the Federal Communications Commission ordered Mebane-based Madison River to pay a $15,000 "consent decree" penalty for blocking customers in Alabama who were legally using voice-over Internet protocol, or VoIP, equipment to make long-distance calls without having to use their phone company.

"The (telephone) industry must adhere to certain consumer protection norms if the Internet is to remain an open platform for innovation," said FCC Chairman Michael Powell in a prepared statement. "We saw a problem, and we acted swiftly."

The FCC's swift action is being viewed as a win for consumers who are trying to cut calling costs by sending some of their calls via the Internet. After consumers invest in specially designed telephones and pay Voip service fees, they can eliminate long-distance calling charges.

Phone companies are complaining that they're being required to maintain the networks that Voip calls still use, but they are not being compensated for that use.

"No one is taking an anti-VoIP stand here; there's just carriers who aren't getting compensated," said Steve Parrott, president of Sprint in North Carolina and president of the N.C. Telecommunications Industry Association.

Executives for Madison River did not return phone calls seeking comment.

Voip equipment provider Vonage Holdings Corp. recently began selling its products across the South. The equipment allows a user to tap into a building's Internet access to make a phone call. While that call still goes across some phone line networks, the phone company isn't paid.

But telephone company network switching equipment can be programmed to block the Internet ports to stop certain calls or even certain kinds of calls.

Vonage complained to the FCC about Madison River engaging in this practice, and the FCC acted immediately.

"This sends a clear message that port blocking will not be tolerated," said Jeffrey Citron, CEO of Vonage in Edison, N.J., in a statement.

But many in the telecommunications industry see the Madison River case as just the first volley in the battle over VoIP-user compensation.

"With these competitive providers there's tension with the incumbent providers," said Nat Carpenter, director of the communications division of the N.C. Utilities Commission, which is watching this case and the debate closely.

New technologies that work on the established telecommunications networks are clouding the issue of compensation.

"It is an issue that has been growing as this technology has caught on," said Parrott at Sprint. "There needs to be some rules established on compensation."

Voip services and equipment are growing and are now being offered by cable TV providers, Internet service providers and traditional phone companies.
