CRTC Begins Studying How To Oversee Voip

Ottawa — The possible regulation of on-line telephone services will be on the table in a review that begins Tuesday by the Canadian Radio-television and Telecommunications Commission, hearings that could help shape the direction of Canada's telecommunications industry — and the commission itself.

The CRTC is poised to determine how — or if — it will regulate the fledgling voice over Internet protocol (VoIP) industry, which has the potential to slash telephony prices, attract a horde of new Internet users, and lead to an overhaul of the lucrative telecommunications services industry.

The three days of hearings, which will include appearances and submissions from most of the Canadian industry's key players, will likely operate on a series of levels, industry experts say. Most of the discussion will largely revolve around whether regulating the nascent industry would qualify as sound public policy. A second level will be about the efficacy of national regulators and other government bodies trying to enforce and control the Internet-based world.

And then there is expected to be the subtext about the federal broadcast regulator itself. If the CRTC decides it is unable to effectively regulate Voip — and many other technologies in the digital age — then the commission's ability to do its job in the electronic era may be called into question.

“It's time the CRTC should just recognize that they're in the way,” said Eamon Hoey, senior partner at telecommunications consulting firm Hoey Associates Inc. of Toronto. “They've got to recognize that the world is moving at a much faster pace.”

Many key telecom players — including large players such as BCE Inc. of Montreal and Telus Corp. of Burnaby, B.C., which have the most to lose from unregulated Voip — agree with U.S. Federal Communications Commission head Michael Powell that regulators should let the market rule. The telecom industry, including the cable television players, is already increasingly unregulated, although the commission still controls the prices of local services sold by the former monopolies on their home turfs.

The former monopolies, such as Telus and BCE's Bell Canada, still control the vast majority of the local telephone services market, and Voip threatens to make it a free-for-all. Voip companies such as Primus Telecommunications Canada and Vonage Canada Inc. are challenging the incumbents with cut-rate plans and other aggressive strategies.

“There's no doubt it's the wave of the future,” Mary Anne DeMonte-Whelan, president of Delan Group of Toronto, said of VoIP.

In April, the CRTC issued its preliminary view of the Voip market, saying Internet-based local phone services should be regulated in the same way as their more traditional rivals.

Critics, however, say that would probably lead to a tilted playing field that would see the former monopolies regulated and their upstart rivals — which may be outside the scope of the commission — operating as they please.

But cable companies, such as Rogers Communications Inc. and Shaw Communications Inc., say they'd like to use Voip to enter the local phone services market. Without regulations, they argue, the incumbent phone companies would be able to squeeze out competitors.
