To get technical- Vonage COULD (if they really wanted to) record a phone call. Vonage adapters use SIP, and SIP uses RTP for media transport (sending voice audio).

When you place a call over SIP, the two SIP endpoints (devices) generally invite each other via a Proxy (that's vonage). One endpoint would be your ATA, the other one would be either Vonage's CLEC or another Vonage server.
Once the SIP call is established, the Proxy will generally re-invite the two sides directly to each other, so the RTP stream (actual voice data) is sent straight from your ATA to the other end, IE the CLEC. This means it DOESN'T go through the proxy, and the proxy can save money because less bandwidth and server capacity are required.
However this does not have to happen. Having Proxy control, Vonage could (if they really wanted to) keep both sides invited to the proxy, which means that the call data would go through Vonage's server and they could then record it.

They don't however, for a few reasons.
1. All the RTP media data would have to pass through their server. That means a LOT more bandwidth and a LOT more server capacity. It costs them quite a bit less not to.
2. Even if they did passthru all the RTP media, to store all of it would be quite expensive. Vonage processes millions of minutes of calling every day, for Vonage to randomly record everybody's calls would cost a fortune in terms of storage space.
3. Even if they did, what would it get them? Why bother? Surely not to resolve a few customer service issues... It would cost orders of magnitude less to simply refund everybody that complained.
4. If they did record every call like that, they would probably be sued, and they would lose. Recording people's phone calls is generally illegal. Spying on your subscribers is not a good business strategy.
