I guess I did not think you were talking about port blocking because you cited Cringley's article. Cringley's article specifically says that we don't need additional regulation to prevent port blocking.

I wish we could drop Telmex, no one is arguing ports can't be blocked. My argument is that port blocking is already something that the FCC acts against and therefore no additional legislation is necessary at this time.

New Port Blocking Cases
Dan's message, "Two broadband providers are causing problems for Vonage's Internet phone traffic, a spokeswoman said Monday, suggesting that a recent federal fine for blocking Vonage calls may not have had its intended impact." is alarming, but I think we should wait to see how the FCC reacts before panicking.

We also know that the FCC acted because of Vonage's complaint against Madison River. It may be that the FCC is going to have to receive complaints for each offending ISP before it will act.

Wireless (or low bandwidth) Networks
With the bandwidth limitations inherent to many older wireless networks it is conceivable that some wireless ISPs are going to have to disallow Voip. Legally they can do this through their terms of service or through bandwidth caps, port blocking is ineffective because it can be easily avoided and is destructive to the nature of the Internet as a cooperative communications network. Currently ISPs practice these behavior to prohibit web servers or limit excessive file sharing. Also, it is less likely that a wireless ISP would be blocking ports to gain an advantage in selling voice service.

Of course if the wireless ISP is, in fact, a 3G mobile wireless service port blocking would make more sense. This type of network service is already plagued with billing difficulties and attempting to charge for Voip type usage is only going to make the situation worse. However these networks have also been characterized by limiting the types of traffic allowed through their gateway, I find it hard to believe that they could be forced into allowing Voip traffic unless they were also selling Voip service which seems counter intuitive when you factor in where they make the bulk of their money.

Port Blocking: Is It Censorship
Vonage CEO Jeffrey Citron calls port blocking censorship against free speech. I disagree with how he phrases this sentiment because the terms he uses are typically only applicable to governmental entities.

That being said, censorship in the US is only a violation of free speech when it is a government action. In certain cases it also applies to regulated commercial entities. However, there are plenty of ISPs around who choose not to carry certain types of content. This is also clearly censorship but not necessarily illegal. There is not a single major cable company currently carrying hard core pornography. This establishes that even regulated carriers get to determine at some level how their network will be used. I think from an Internet centric point of view Mr. Citron is essentially correct. Blocking at the port level without a significant technical reason, for example stopping virus propagation, is a fundamental attack on the openness of the Internet.

For the record, I am on Comcast and not experiencing problems. However Comcast is a large company aggregated from a number of acquired companies so that doesn't rule them out altogether.
