WASHINGTON (Dow Jones)-A federal district appeals court on Tuesday did not issue a ruling from the bench over whether to uphold a lower court's injunction preventing Vonage Holdings Corp. (VG) from signing up new customers.

The court was holding a rare hearing in which it heard arguments from lawyers representing Vonage and Verizon Communications (VZ) in a patent dispute that has the potential to bankrupt Vonage.

Usually these types of matters are decided without oral arguments.

A lower federal district court had ruled that Vonage could continue to service existing customers but couldn't sign up any new customers pending the outcome in an appeal in the original trial, of which Vonage was on the losing end.

That decision has prompted much speculation among analysts whether Vonage could afford to continue in business until the appeal is heard in the original jury verdict.

That verdict was that Vonage had infringed on three Verizon patents. It was ordered to pay a $58 million fine and 5.5% royalties on any future infringements.

The judge went further and told Vonage it couldn't sign up any new customers until the matter was resolved.

Tuesday's hearing dealt primarily with arguments from the companies' lawyers over whether Vonage's appeal of the jury verdict had merit.

According to Rebecca Arbogast, telecommunication analyst with Stifel Nicolaus, this likely meant the judges were convinced of Vonage's argument that it could be in financial difficulty without a stay of the injunction.

Lawyers for both sides said it was difficult to know whether the court would issue an opinion later Tuesday.

The three-judge panel is left with a number of options.

It could stay the entire injunction, which would mean Vonage could continue to sign up new customers until an appeal in the underlying verdict was heard - likely some 12 to 18 months away.

Or, it could stay injunctions on any of the three patent infringements individually.

The third option would be to uphold the lower court injunction in its entirety, which would be the most damaging for Vonage.

Vonage's lawyer, Roger Warin, argued that even if the court only upheld the injunction on the wireless patent infringement, it could still reduce the company's new business by as much as 50%.

This is because while only a small number of the devices it provides customers with are wireless only, a number can be used for wired or wireless functions.

Warin argued that Vonage would have to stop supplying all of these devices under the lower court's injunction.

"You've got a real chance of insolvency on the part of Vonage" if the injunctions are upheld, Warin told the hearing.

The three judges gave little indication as to their thinking in the case. Warin was subjected to more aggressive questioning than his counterpart, but that would be expected given it is Vonage seeking to overturn the lower court's ruling.

Shares of Vonage recently were up 16 cents, or 5.5%, at $3.05.
