WASHINGTON (Dow Jones)-A federal district appeals court on Tuesday did not issue a ruling from the bench over whether to uphold a lower court's injunction preventing Vonage Holdings Corp. (VG) from signing up new customers.
The court was holding a rare hearing in which it heard arguments from lawyers representing Vonage and Verizon Communications (VZ) in a patent dispute that has the potential to bankrupt Vonage.
Usually these types of matters are decided without oral arguments.
A lower federal district court had ruled that Vonage could continue to service existing customers but couldn't sign up any new customers pending the outcome in an appeal in the original trial, of which Vonage was on the losing end.
That decision has prompted much speculation among analysts whether Vonage could afford to continue in business until the appeal is heard in the original jury verdict.
That verdict was that Vonage had infringed on three Verizon patents. It was ordered to pay a $58 million fine and 5.5% royalties on any future infringements.
The judge went further and told Vonage it couldn't sign up any new customers until the matter was resolved.
Lawyers for both sides said it was difficult to know whether the court would issue an opinion later Tuesday.
Shares of Vonage recently were up 24 cents, or 8.3%, at $3.13.
